Builder-Developer's insurance: what does it cover?

Builder-Developer's insurance covers all claims that incur your decennial liability, i.e.:

  • Damage that compromises the solidity of the structure, such as the appearance of cracks considered to be significant in the walls and floors, framework subsidence or collapses resulting from a constructional defect or faulty workmanship.
  • Damage rendering the property uninhabitable or unfit for purpose. This relates to defective equipment that cannot be separated from the building (heat pump, underfloor heating, door and window frames, etc.), insulation defects or lack of waterproofing.

The Builder-Developer's insurance is active as soon as the structure is handed over to the client and runs for ten years. It differs from the ten-year guarantee, which is intended for builders only and often requires a dedicated contract. Builder-Developer's insurance can be offered as an option with Structural Damage insurance and is aimed at companies that have a property built but do not build it themselves. These two contracts, although they cover the same risks, are aimed at two different types of client.

Is insurance's insurance compulsory?

For professional Builder-Developers, taking out Builder-Developer's insurance is a legal obligation set by the Spinetta Law (Law no. 78-12 of 4 January 1978). It stipulates that "anyone who carries out construction work on behalf of others must be covered by liability insurance guaranteeing the damage referred to in Articles 1792 and 1792-2 of the French Civil Code. ".
