As the contracting authority, you are the owner of the work, both for renovations and new constructions. As such, you may be held liable for any damage that occurs on the construction site.

It is therefore essential to take out a project owner's liability insurance policy before the start of the project, in parallel with building all-risk insurance. This will cover any risks caused to third parties from the start of the work until the structure delivery date.

Third parties include: owners of buildings in the vicinity of the structure, passers-by, visitors, neighbours (neighbouring buildings), as well as cars parked nearby.

It should be noted that if, technically, the damage is not directly caused by the contracting authority but by someone working on the site, for example, the contracting authority's civil liability is often involved.

What does the Contracting Authority Civil Liability Insurance cover?

Contracting Authority Civil Liability insurance covers you against personal injury, property damage and non-material damage that may be caused to third parties throughout the duration of the work.

Damage to property

Scaffolding falling on a parked vehicle, a wall collapsing and affecting a neighbouring building, the destruction and deterioration of objects or buildings belonging to a third party, are all considered to be cases of damage to property.

Non-material damage

This concerns all economic damage related to the deprivation of a right. This is the case, for example, if it is not possible to use one's car to go to work because of an accident; or the obligation to close a shop following water damage caused by the work.

Personal injury

An object falling on a passer-by, an injured worker, a death on the site... bodily injury means all risks affecting the physical integrity of a person following an accident.
