Construction damage insurance

The construction of new buildings or the renovation of existing structures requires professional project owners (real estate developers) or private individuals (homeowners, industrial or commercial property owners) and their potential representatives (condominium managers) to take out certain insurances. Construction Damage cover

Taking out a guarantee against Structural Damage is a legal obligation for contracting authorities, whether they are private individuals or professionals. Its objective is clear: to protect your assets and/or investments.

Structural Damage insurance covers the building within ten years of acceptance for any damage that compromises the solidity of the building or makes it unfit for its purpose, such as:

  • Water seepage from the facade, from an embedded pipe or from the roof;
  • Collapse of the roof, structural work or a wall;
  • Defects in the thermal insulation of the walls that can lead to excessive energy consumption;
  • Floor subsidence;
  • Faulty air conditioning or heating;
  • A lack of sound insulation;
  • An insufficiently wide stairwell;
  • Non-compliance with accessibility standards for PRMs (People with Reduced Mobility);
  • Etc.

Introduced by Law 78-12 of 4 January 1978, Structural Damage insurance is a compulsory insurance policy that pre-finances, for ten years following acceptance of the work and without any search for liability, the total and rapid repair of damage for which the builders are responsible under Articles 1792 et seq. of the French Civil Code.

Construction Damage and Builder-Developers

The law considers a builder to be, among other things, any person who sells a structure that the person has built or had built after its completion. This applies in particular to a property developer or property trader who has had building work carried out, who in this case is called a Builder-Developer.

In addition to a Structural Damage insurance contract, the Builder-Developer will have to take out a contract for Decennial Liability insurance. These two guarantees are required by the notary when property is being sold.

Construction Damage insurance and Architects

The architect, bound by a contract to a contracting authority, is also a builder under the law. The duty of architects to advise requires them to remind the client of the obligation to take out Structural Damage insurance. The architect must stipulate this in writing in the general clauses of the contract and reserves the right to refuse to implement the project if the client has not taken out Structural Damage cover.

Construction Damage insurance and management agents

The co-ownership property management agent may be held liable for work on the common parts of a building (restoration of facades, repair of roofing, waterproofing work on roof terraces, creation or modification of openings in the supporting structure, waterproofing of balconies, etc.).

In this case, the management agent must offer insurance cover for structural damage to the co-owners (by voting), clearly stipulating the compulsory nature of this insurance. The agent then acts as the representative of the contracting authority, the co-owners.
